"NISOA Mechanic for Issuing a Second Caution" By: Kenneth G. Andres, Jr. National Rules Interpreter
I am receiving multiple inquiries from NISOA officials regarding the proper mechanic for the display of cards when a player commits a second cautionable offense in the same game.
The NISOA 2008 Preseason Guide contains an article on page 1 entitled "Second Card is Always Red," which sets forth an incorrect officiating mechanic with regard to NCAA Men's and Women's Soccer Rule 5.5.3. The article incorrectly states that the referee should not display a yellow card when issuing a second caution to a player. This is not correct and wrongfully interprets a 2008-2009 clarification of R.5.5.3, which addresses the issue of a second caution for Accumulated Cautions and Game Suspensions purposes pursuant to Rule 12.18.1. A player cannot be "charged" with a second caution in the same game for card accumulation purposes within R.12.18.1, but this clarification does not change the NISOA officiating mechanic when a player commits a second cautionable offense.
The proper officiating mechanic when a player commits a second cautionable offense is as follows: The referee shall display a yellow card, followed immediately by a red card. See R. 5.5.3.

ASSIGNOR INSURANCE UPDATE |

The NISOA Board of Directors purchased a "Professional Liability Policy" to insure NISOA Assignors for their involvement beyond the levels of officiating a game. For many of us, the reason your Chapter Assignor needs this coverage has not come through loud-and-c1ear. This article should amplify the issue:
1) NISOA Referees have always had Bodily Injury and Property Damage Liability coverage in the course of officiating a game. As long as you paid your membership dues to NISOA, this coverage was automatically included.
2) Previously, NISOA Assignors, have not had protection for a mistake in judgment within their duties to obtain officials for a match. Without protection, for example, an Assignor would be personally at-risk if they do not pay the required chapter dues for Assignor's Professional Liability. ($110.00 per annum per assignor, per Chapter)
What is the difference? If a referee was named in a lawsuit regarding an injury to a player from a game event, the NISOA Commercial General Liability (CGL) provides protection. However, if an Assignor was named in the same suit as being negligent in the supervision, evaluation or training of the official, the CGL coverage does not apply. In essence, prior to this Assignor's Liability Insurance purchase, the assignor had no protection for a professional "error or omission" in the assignment process. This "mistake in judgment" was not previously insured because all CGL type policies EXCLUDE errors or omissions coverage.
Why is this important? Assignors should be keenly aware that "Judgment Lawsuits" are occurring in many avenues of life. Insurance agents, real estate agents, computer consultants, doctors, and even lawyers have professional liability insurance to protect for an error that generates a lawsuit opportunity or an omission that does the same. Assignors are involved in decision making processes that could come into question in a court of law. "Why did you send THAT referee to do this game (in which an injury occurred) when you could have used a much more qualified referee?" NISOA has provided the protection with our "Professional Liability" policy.
What does a Chapter need to do? Make sure you enroll each one of your NISOA Assignors in the policy. At $110.00 annually per enrollee, the cost is negligible. This coverage provides One Million Dollars of protection where none exists without enrollment. NISOA Assignors need to understand that without coverage, your personal assets are at risk and there is no representation provided for legal defense from a lawsuit, without paying the dues!

ANDRES NAMED NISOA EXECUTIVE DIRECTOR
Kenneth G. Andres, Jr., (Haddonfield, NJ) has been named the Executive Director of the National Intercollegiate Soccer Officials Association (NISOA), succeeding Dr. Raymond Bernabei who passed away on September 5,2008, after leading NISOA for nearly forty years. NISOA is an organization of more than 5,000 soccer officials which trains, certifies and provides qualified referees for the college soccer community throughout the country. Andres will serve as the Interim Executive Director pending the selection of an individual to lead NISOA on a full-time basis.
Selection as NISOA's Executive Director marks yet another achievement in the life of the 54-year old Trenton, NJ native, who has enjoyed unparalleled success throughout his career as a both player and referee, reaching the pinnacle in both areas.
Speaking of his predecessor, Andres said, "The American soccer community lost an icon with the passing of Dr. Raymond Bernabei who was the recognized leader of the intercollegiate soccer officiating community. Thanks to the vision and leadership provided by Ray Bernabei over the last 40 years, NISOA has become recognized as a strong, vibrant organization of great people dedicated to one thing- serving the college soccer community. Ray built the framework for NISOA and taught us the leadership skills necessary to succeed and improve this great organization, which we will do."
Andres is believed to be the only person to have participated in state high school and NCAA Championship Finals as both a player and referee.
Inducted into the National Soccer Hall of Fame and the Mercer County Hall of Fame in 2002, Andres was also a recipient of the Robert E. Sumpter Award for Excellence in Teaching in 2001 for his service as a National Clinician. Andres served as the President of NISOA for 2003-2004, and continues to serve as legal counsel, a National Clinician and the NISOA College Rules Interpreter and liaison with the NCAA Men's and Women's Soccer Rules Committee. He was voted New Jersey Soccer Coaches Referee of the Year in 1987 and 1994 and the Intercollegiate Soccer Official's "Man of the Year" in 1989 and 1997.
Ken was a member of Steinert High School's (Trenton, NJ) 1970 squad that won the NJSIAA Group IV State Championship finishing 17 -1- 3. A defensive stalwart, he helped that Steinert team allow only 4 goals in 21 games.
Andres went on to star at Swarthmore College where he was a three year varsity starter and captain the 1974 team that went to the NCAA Division III National Finals.
Although he distinguished himself as a superb player, Ken has been even more outstanding as an official, earning recognition as one of the top referees in the nation and a leader in referee education.
A member of the National Intercollegiate Soccer Officials Association since 1976, the Intercollegiate Soccer Officials of New Jersey, the Central Jersey Referees Association and the United States Soccer Federation, he has been cited countless times for his work as an author and instructor with the referee boards.
Andres really made his mark as a college referee, becoming a fixture in major college playoff games. Named a National Referee in 1984, he has refereed over one hundred college tournament playoff matches, including fifty-four national semi-final or championship games in NCAA Men's and Women's Division I, II and III, NAIA Division I Men's and NJCAA Division I Men's. He has officiated in the ACC, AIO, Big East, Big Ten, Conference USA, Ivy League and the Patriot League.
A prominent trial attorney with the firm of Andres & Berger, P.C., in Haddonfield, NJ, Andres is Certified by the Supreme Court of New Jersey as a Civil Trial Attorney. He was named the New Jersey Professional Lawyer of the Year in 1998 and elected President of the Association of Trial Lawyers of America-New Jersey in 1999. A recipient of the Trial Attorneys of New Jersey Civil Trial Bar Award "For Distinguished Service in the Cause of Justice" in 2006, Ken currently represents as a National Governor for the American Association for Justice and is an Adjunct Professor of Law at Rutgers University-Camden Law School. He was also named as the Top Civil Trial by South Jersey Top Personal Injury Lawyer by SJ Top 100* SuperLawyer by the publishers Jersey Monthly and listed in the in America. |

COLLEGIATE SOCCER REFEREE RECRUITMENT PROGRAM LAUNCHED
The National Intercollegiate Soccer Officials Association (NISOA) has launched a recruitment program for training and certifying collegiate referees. The emphasis of this initiative is locating qualified female and/or minority individuals who are interested in being trained on officiating at the college level. Participating individuals will receive a scholarship to attend the NISOA National Training Academy in July, 2009. This four day residential program provides classroom and on-field training, physical fitness training, and the opportunity to referee games and receive feedback from certified clinicians who teach at the camp. In addition, participants who complete the training program may apply for college credits with the University of Colorado. The scholarship program was made possible by a grant from the NCAA. Any soccer referee with 3 years experience may be eligible for membership with NISOA. During the camp, these individuals will have the opportunity to take the written entrance examination and the physical fitness examination. These are two of the main components for membership. Individuals with less experience are also encouraged to apply for a scholarship and attend the program. Application for membership can be made at a later date when the experience component is satisfied. Individuals who want to improve their skills as a high school referee should also consider attending the camp. The programs presented are generic to college and high school soccer and benefit anyone who referees at these levels. NEW/EXPANDED APPOINTMENTS Larry Dorsey
As president of NISOA, I am pleased to announce three appointments to better serve the membership and our organizational needs. Each position has been reviewed to insure a manageable workload while meeting today’s needs in our growing soccer community. Each individual brings a wealth of experience and commitment to NISOA to insure NISOA continues as the leading Intercollegiate and Interscholastic referee organization.
Cliff McCrath has been appointed the Director/Liaison of NISOA Communications. Cliff’s primary responsibility will be to interface and serve as a liaison with our outside constituents such as the NCAA, NAIA, NSCAA, NCCAA, NJCAA, and others.
John Van de Vaarst has been appointed Director of Operations. He will be responsible for the day-to-day activities of NISOA as well as long range planning. He will manage the budget and expenditures, maintain and update all NISOA publications and the Policy Manual, and oversee the web page. He will respond to questions from chapter contacts and members, and coordinate agendas for the Executive Council and Annual Conventions. He will be responsible for the logistical planning for the Annual Convention, the NSCAA convention and all workshops and training programs of the various Program Directors.
Mario Donnangelo will continue as an Associate Executive Director, with additional responsibilities. He will handle all NISOA membership issues, coordinate the awards programs’ and be the primary contact with our insurance carrier and chapter contacts on insurance matters.
Detailed biographical information will be available for these individuals in the near future and posted on the web. I am confident that their leadership and management skills will allow NISOA to move forwarded and continue as a viable and leading soccer referee organization. |
